These conditions, together with the relevant web site description, form the Client’s contract with the Company. In these conditions, the “Company” shall mean B’NB BORDEAUX AROMAS, registered in France. The “Client” shall mean the signatory of the booking form and everyone named in the booking form.
1. Contract
In order to make a booking, the Client must complete and sign a booking form and send it to the Company with a deposit representing 30% of the total payment or full payment as applicable. A contract will come into existence between the Client and the Company at the point the company dispatches its confirmation invoice. The Client must notify the Company within 10 days of the confirmation invoice if such confirmation does not confirm accurately the Client’s reservation, failing which the Client shall be bound by the terms of the confirmation invoice. All agreements and descriptions that form the basis of this contract, or alter it, are to be in writing.
2. Law and Jurisdiction
The contract between the Client and the Company and any matters arising from it shall be subject to French law and to the jurisdiction of the court of Bordeaux, Gironde, France.
3. Prices
Prices include all items specified in the booking form and confirmed by the Company’s confirmation invoice. The Company reserves the right to change any of the prices contained on its web site at any time before it enters into a contract with the Client. If there is any change, the Company shall notify the Client before it enters into a contract.
4. Payment of Balance Due
The full price of the holiday must be paid to the Company at least 8 weeks before arrival. If full payment is not made at least 8 weeks before arrival, the Company reserves the right to cancel the booking and retain the deposit
5. Alterations by the Company
The contents of the holidays have been carefully arranged and the descriptions on the web site are as accurate as possible. However, changes can become desirable or unavoidable. Most operational changes are of a minor nature and although the Company is not obliged to inform the Client, we may well do so. Where it is necessary to make a “significant change”, the Company will inform the Client as soon as possible before arrival. The Client may then:
a. accept the change or
b. cancel the booking and receive a full refund of all monies paid to the Company. Such refund will not be applicable in cases of “force majeure”.
For the purposes of the contract with the Company, a “significant change” is defined as the incapacity of all of the professional wine teachers and/or the bilingual organisers and guides to provide their services during the period you have booked your holiday. For the purposes of this clause, “force majeure” means unusual and unforeseeable circumstances beyond the control of the Company, the consequences of which could not be avoided by the Company, even with the exercise of all due care.
6. Cancellation by the Client
If the Client cancels the holiday, a charge will be made which varies according to the time the Company receives a written cancellation notice signed by the person who signed the booking form.
| Date of Receipt of Cancellation
| Amount of Charge
|
| More than 58 days prior to arrival
| Loss of deposit
|
| 56 to 45 days prior to arrival
| 50% of total price
|
| Less than 45 days prior to arrival
| 100% of total price

7. Cancellation by the Company
The Company reserves the right to cancel the Client’s reservation though this is an extremely rare occurrence. Should this happen, the Company will give the Client as early notification as possible and the Client will be entitled to book another holiday at any other period available or be entitled to a full refund. In the case of cancellation due to low bookings, the Company will advise the Client no later than 56 days prior to arrival. For the purposes of this contract, low bookings is a situation in which the minimum of persons having reserved for the holiday period the Client has chosen is less than four.
The Company will not be liable for refunds of travel costs or any other costs incurred by the Client for services which have not been arranged through the Company.
8. Health and Safety
Clients who are not resident in France should obtain information from their country’s Department of Health on the necessary measures to take on protecting their health in France. The Company advises that anyone who is not in good health or is pregnant, elderly or who suffers from serious health problems should only travel with their doctor’s consent and should ensure they bring correct medicines.
9. Age and Fitness
Clients must be 18 years old or more.
If the Client has any difficulty walking or if there is any other factor which makes it difficult to take part in any part of the holiday unaided, the Client must discuss these difficulties with the Company before booking. The transport provided by the Company is not adapted for wheelchairs. If the Client uses a wheelchair, he must notify the Company before booking.
10. Behaviour of the Client
The Client undertakes to behave in an orderly fashion and not to disrupt the enjoyment of others. The Client is liable for all damage and losses caused by his actions.
